SC TRASHES DEATH SENTENCE BY PAK MILITARY COURT

Pak Supreme Court stayed execution of a convict sentenced to death by the military court on 24 Jul 17. A three-member bench headed by Justice Ejaz Afzal heard the case and issued a notice suspending the death sentence to the concerned parties. The judges also adjourned the hearing for an indefinite period. The convict named Mohammad Akbar had been awarded death sentence by the military court over charges of killing two Army officials in 2009.

View Point:

   Earlier, Apex court had suspended the death sentence of two prisoners convicted by the military courts, namely Fazl Rabbi and Saeed Raheem, who faced charges of terror activities in SWAT.

   Military Courts of Pakistan, popularly called Kangaroo Courts, do not have the adequate knowledge of law and often pass sentences as per their whims and fancies. The curious case of Kulbhushan Jadhav is a case in point, where a military court awarded a death sentence without going into the merits of the case.
